KITE provides official dealers (hereinafter referred to as "Official Dealer" or "KITE Dealer") with the opportunity to order products. The Official Dealer is not an employee of LLC "VIVAT TRADING" (LLC "VIVAT TRADING" is the official distributor of the KITE trademark products). Therefore, KITE does not control and is not responsible for the collection, use, and disclosure of information by Official Dealers, including for their marketing purposes. If you provide information to an Official Dealer through the Site, KITE will have access to it and will process it in accordance with this Privacy Policy. Official Dealers may provide KITE with information about you; in this case, upon receiving such information, KITE processes it in accordance with this policy.

CONSENT TO THE PROCESSING OF PERSONAL DATA

By checking the "I confirm" box, I (the individual giving this Consent) acknowledge and hereby consent to the fact that VIVAT TRADING LLC (the "Company") will collect, store, and process my personal data for the purposes of business management, compliance with legal obligations, and tax payments. The data concerning me shall include, among other things: full name, gender, passport details, registered and actual address, telephone number, and any other personal data that has been/will be provided by me or otherwise disclosed to and/or received by the Company and/or API from third parties (hereinafter referred to as the “Data”).

I acknowledge that I may at any time access my Data being processed, request necessary corrections, and withdraw my consent by sending a written notice to: 18 Hetman Polubotok St., Chernihiv, 14000, Ukraine.

I understand that motivated requests for amendment or deletion of Data must be sent in writing to the address above. I give my unconditional consent to the Company and the API to transfer my Data to foreign subjects of personal data relations (cross-border transfer), including any of their affiliates. I agree that the Company, the API, and any of their affiliates, including those located abroad, may transfer the collected Data to third parties who assist the Company and/or the API and their affiliates in managing business operations and who have contractual obligations to maintain the confidentiality of the Data, including but not limited to service providers. These third parties and affiliates may be located in the EU and in other countries.

I confirm, understand, and agree to the following:

1. I have been duly informed about the inclusion of my Data in the Company's personal data database, the purpose of collecting and processing such data, and the transfer to third parties. My consent does not require separate notification;

2. I have read the Notification on the Personal Data Controller, the composition, content, and purpose of data collection, and the parties to whom personal data may be transferred, as well as the rights of the data subject;

3. I agree to changes to or deletion of my Data after the term specified below without additional notice of such changes/deletion;

4. The processing (including use) of my Data may be carried out in countries with data protection laws different from those of Ukraine;

5. I have read the Company’s Privacy Policy available at https://mykite.com.ua for further information on the Company’s procedures to ensure data confidentiality and protection.

This consent to the processing of personal data is valid for three (3) years from the date it is granted. After this period, the consent is automatically extended for each subsequent three-year period unless a notice of withdrawal is received. Since the need for the API to process the Data in accordance with this Consent may arise in the future, this consent is granted with a suspensive condition under Article 212 of the Civil Code. I understand and agree that the API will process my Data only from the moment I receive a notification as stipulated by Article 12 of the Law “On Personal Data Protection” or another notification as required by the legislation of Ukraine at the time of such notice.

2. Your data includes, among other things: full name, gender, passport details, registered and actual residence address, telephone number, and other data provided or received from third parties;

3. The data will be processed based on your consent for business management, compliance, and tax purposes;

4. The Company and its affiliates, including those abroad, may transfer your personal data to third parties assisting with business operations, who are contractually obligated to maintain confidentiality. These recipients may be located in the EU or other countries.

According to the Law “On Personal Data Protection”, data subjects have the right to:

1. Know the sources, location, and purpose of data collection and processing, and the location of the controller or assign a representative to access this information (unless restricted by law);
